License Agreement
NOTICE:
You may use the software only if you accept all of the terms
contained in this license agreement. Before you install the
software, please read the terms and conditions of the agreement.
By installing, copying, or otherwise using any of the software,
you agree to be bound by the terms of this agreement. If you do
not agree to the terms of this agreement, you are not authorized
to use the software.
LICENSE:
The software that accompanies this license (Sketcher PLUS) is
protected by copyright law. While Palmetto Logic continues to
own the software you will have certain rights to use the software
after your acceptance of this license. Your rights and obli-
gations with respect to the use of this software are as follows:
1) Palmetto Logic grants to you a personal, non-exclusive,
non-transferable and royalty-free license to install and use the
software for your lawful personal use. The software may only be
installed on computers and handheld devices controlled by you.
2) You may make copies of the software as may be necessary for
backup and archival purpose.
3) Under no circumstances are you allowed to distribute this
software unless authorized by Palmetto Logic or its owner(s).
Disclaimer Of Warranty
Palmetto Logic expressly disclaims any warranty for the software.
The software and any related documentation is provided "AS IS"
without warranty of any kind, either express or implied,
including, without limitation, the implied warranties or the
merchantability, fitness for a particular purpose, or non-
infringement. The entire risk arising out of use or performance
of the software remains with you.
LIMITATION OF LIABILITY:
You must assume the entire risk of using the software. Any
liability of the seller will be limited exclusively to product
replacement or refund of purchase price. The software is not
specifically developed or licensed for use in any nuclear,
aviation's, mass transit, life support, medical or any other
inherently dangerous applications.
In no event shall Palmetto Logic or its owners be liable for any
damages whatsoever (including, without limitation, damages for
loss of business profits, business interruption, loss of business
information, or any other pecuniary loss) arising out of the use
of or inability to use this product, even if Palmetto Logic has
been advised of the possibility of such damages.
